Types Of Custody

In Michigan, there are two custody components that need to be addressed: physical custody and legal custody. Physical custody refers to the day-to-day care of the child and where the child will live. Legal custody refers to the important decisions that affect the welfare and well-being of the child, usually in regard to medical, educational and religious matters. Parents with joint physical custody share in the actual living arrangements, generally on a rotating basis at each parent’s home. Parents with joint legal custody share in the decision-making process on significant matters affecting the child. Parents can agree to custody.

When parents do not agree, the court will usually refer the issue to the friend of the court for an investigation and recommendation.
