Custody Birmingham MI

Your Child Custody Expert Birmingham MI

In divorce cases that involve children, custody is generally the most complicated and emotional part of the process.  Sadly, parents lose sight of this.  What is best for the children is always the primary consideration – for parents as well as the court.  You can help your children through this painful process by maintaining positive co-parenting skills.  Your marriage may end, but your role as a parent does not.  Refrain from arguing or saying negative things in front of the children.  Whenever possible, be openly supportive of the other parent in front of the children.  Support the other parent’s involvement in your children’s daily routine.  Positive co-parenting may be difficult during this stressful time, but your children are worth it. Call Delia A. Miller, PLLC serving Birmingham Michigan for any questions.

In Birmingham Michigan, there are two custody components that need to be addressed:  physical custody and legal custody.  Physical custody refers to the day-to-day care of the child and where the child will live.  Legal custody refers to the important decisions that affect the welfare and well-being of the child, usually in regard to medical, educational, and religious matters.

Parents with joint physical custody share in the actual living arrangements, generally on a rotating basis at each parent’s home.

Parents with joint legal custody share in the decision-making process on significant matters affecting the child.

Parents can agree to custody.  When parents do not agree, the court will usually refer the issue to the Friend of the Court for an investigation and recommendation.  If either party objects to the Friend of the Court’s recommendation, the court will make a determination using the “Best Interest Factors” listed in Michigan Statute 722.23.
